1. Acceptance of Terms

By downloading, installing, or using the Tunesday mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Tunesday is a social music sharing application that allows users to:

• Record 30-second voice notes about their favorite songs
• Share music weekly or anytime with friends and followers
• Connect with Spotify and Apple Music for seamless music sharing
• Receive automatic weekly music reminders every Tuesday
• Discover curated music recommendations every Friday
• Comment on posts, reply to comments, and mention friends with @username
• Like posts and comments
• Follow friends and receive push notifications for social interactions
• Tag posts with emotional vibes and captions
• Send and receive direct messages and shared songs with other users

3. User Accounts

To use Tunesday, you must create an account and provide accurate information. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Keeping your contact information up to date
• Managing your notification preferences

4. User Content

When you submit, post, or share content on Tunesday — including text captions, voice notes, and any audio recordings ("User Content"):

• You retain ownership of your User Content
• You grant Tunesday a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and distribute your User Content solely to operate and provide the service
• You represent and warrant that you own or have the necessary rights, licenses, and permissions to submit your User Content and to grant us the license above
• You are solely responsible for your User Content and any consequences of posting it
• Voice notes must be your own original commentary. Do not record copyrighted audio — including songs, recordings, or broadcasts — even as background audio
• We reserve the right to remove any User Content that we believe violates these Terms or applicable law, without prior notice
• You may delete your content and voice notes at any time; deletion removes content from public view but copies may persist briefly in backups

5. Music Service Integration

Tunesday integrates with third-party music services:

• We provide links to Spotify and Apple Music but do not control these services
• Your use of these services is subject to their own terms and policies
• We do not access your private music listening data
• Music availability depends on the respective service's catalog

6. Direct Messages

Tunesday includes direct messaging between users. By using this feature:

• You agree not to use direct messages to harass, threaten, or spam other users
• Message requests from non-mutual connections require the recipient's approval
• Reported messages may be reviewed by our moderation team
• You may block users or leave conversations at any time

7. Push Notifications

By using Tunesday, you may receive push notifications for:

• Weekly music sharing reminders
• Curated music discovery
• Social interactions (likes, comments, mentions, friend requests)
• Direct message and message request notifications
• You can manage notification preferences in your app settings

8. Prohibited Conduct

You agree not to:

• Share inappropriate, harmful, or offensive content
• Harass, bully, or harm other users
• Violate any applicable laws or regulations
• Attempt to hack, reverse engineer, or disrupt the service
• Upload or transmit any content that infringes a third party's copyright, trademark, or other intellectual property rights
• Record or share voice notes that contain copyrighted audio, music recordings, or broadcasts you do not own or have a license to use
• Create fake accounts or impersonate any person or entity
• Use the service for spam, phishing, or any unauthorized commercial purposes

8a. Repeat Infringers

Tunesday will terminate the accounts of users who are determined to be repeat infringers of intellectual property rights in appropriate circumstances, in our sole discretion.

9. Copyright Policy (DMCA)

Tunesday respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), we will respond to valid notices of copyright infringement.

How to Submit a Takedown Notice

If you believe content on Tunesday infringes your copyright, send a written notice to our Designated Agent containing:

• Your physical or electronic signature
• Identification of the copyrighted work you claim has been infringed
• Identification of the material you claim is infringing and its location on our service (e.g. a URL or description)
• Your contact information (name, address, phone number, email)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notice

If you believe your content was removed in error, you may submit a counter-notice to our Designated Agent containing:

• Your physical or electronic signature
• Identification of the removed content and its location before removal
• A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
• Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal district court for your district

We will process valid counter-notices in accordance with applicable law. Submitting a false or fraudulent notice or counter-notice may result in liability for damages.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information, including voice notes and social interactions.

11. Termination

We may terminate or suspend your account if you violate these Terms. You may delete your account at any time through the app settings.

12. Disclaimers

Tunesday is provided "as is" without warranties. We are not responsible for:

• Content shared by other users
• Third-party music service availability
• Interruptions in service

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the app or email.
